These terms govern your purchase of an advertising slot on The Duke (the “Vehicle”), a 2019 Mini Cooper S owned by Adam Esch, operating as Esch Systems (“Owner,” “I,” “me”). By purchasing a slot, you (“Sponsor,” “you”) agree to these terms. If you don’t agree, don’t purchase a slot.
One of 18 advertising slots on the Vehicle for a one-time payment of $500. Your logo or name is displayed as a decal on the physical Vehicle and as a graphic on the interactive 3D model on this site. This is a one-time purchase — there is no subscription and no recurring charge, ever.
“Lifetime” means for as long as I continue to own the Vehicle. It is tied to my ownership of this specific car — not a fixed number of years. Your placement persists through washing, repairs, modifications, and wraps. I may reprint, resize, or reposition your decal as needed (for example, after bodywork or a new wrap) and will make reasonable effort to keep it displayed throughout my ownership.
If I sell, total, lose, have repossessed, or otherwise cease to own the Vehicle, the display ends and no refund is owed. A slot is a one-time contribution tied to the life of my ownership of the car.
You may select an available zone at the time of purchase. Final placement, size, and appearance are at my reasonable discretion so that logos fit the Vehicle and remain tasteful, safe, and legal (for example, not obscuring lights, mirrors, license plates, or glass needed to drive). I may relocate a logo when required for safety, repair, inspection, or law.
I reserve the absolute right, in my sole discretion and for any reason or no reason, to decline, refuse, remove, or refund any sponsorship — including because I do not wish to associate with a particular person, brand, message, or logo. If I exercise this right, I will refund the amount you paid in full and remove your logo if it has already been placed. This is a reservation of my discretion and does not create any obligation to monitor, review, or act.
I will not display content that, in my sole judgment, is or involves:
You grant me a non-exclusive, worldwide, royalty-free license to reproduce and display your name, logo, and marks on the Vehicle and in photos, videos, 3D renders, and marketing or social media related to this project, for the duration of your sponsorship. You represent and warrant that you own or have the right to use the logo and marks you submit, and that they do not infringe anyone else’s rights. You agree to indemnify and hold me harmless from any claim arising out of your submitted marks.
This is goodwill advertising. I make no guarantee of any specific exposure, impressions, reach, audience, placement duration (beyond my ownership of the Vehicle), or business result. I drive and park the Vehicle at my own discretion. The display is provided “as is.”
Except where I choose to refund under Section 5, or where a refund is required by law, sponsorships are a one-time purchase and are non-refundable once your logo has been produced or placed. Before production, you may request a refund. Refunds are issued to your original payment method through Stripe.
Payments are processed by Stripe; I do not receive or store your card details. I collect your email address to send your confirmation and to contact you about your sponsorship, and I store the logo you upload in order to display it. I will not sell your information.
A sponsorship is an advertising arrangement and a contribution toward keeping the car. It is not a security, loan, equity, ownership interest, or investment of any kind, and it confers no financial return.
I may update these terms; the version posted here governs. Material changes will not retroactively reduce what you already purchased.
To the maximum extent permitted by law, my total liability for any claim relating to a sponsorship is limited to the amount you paid ($500), and I am not liable for any indirect, incidental, or consequential damages.
These terms are governed by the laws of the State of South Carolina, USA.
